The Contribution of “Extra” Judges

Commentators have often lamented the burgeoning caseload in the U.S. Courts of Appeals and the consequences thereof. Given that additional judgeships are not forthcoming from Congress, the circuits have established various means by which to deal with their burgeoning caseload, including utilizing judges other than those active in their own circuit to decide cases. This Article focuses on the use of “extra” judges by the circuit courts.
